Boss expects OT everyday but no OT pay, what are my rights?

Work in a manufacturing SME, gaji RM3000. Boss makes us stay back 2-3 hours almost daily but never pay OT, say it is "part of the job". Is this legal? Can I claim, and will I get blacklisted if I complain?

Under the Employment Act (now covers all employees), overtime on a normal working day must be paid at 1.5x your hourly rate, rest day and public holiday even higher. Your boss saying "part of the job" does not override the law lah. Steps: (1) Start documenting - keep records of your actual in/out times daily (photo of punch card, screenshots, a diary). Evidence is crucial. (2) Raise it politely in writing (email) first asking about OT policy, creates a paper trail. (3) If ignored, lodge a complaint at Jabatan Tenaga Kerja (Labour Department) - it is free and they can order back-payment. On blacklist fear: it is illegal for them to victimise you for asserting your rights, and honestly a company that abuses OT is not one to stay loyal to. Many people quietly job hunt while documenting, then claim on the way out.

I was in the same boat at a SME. Reality check - claiming while still employed is very hard, environment becomes toxic. What most people do is document everything quietly, find a better job, then file the OT claim after leaving. You got 60 days-ish window to claim. Protect yourself first bro.

Check your employment contract wording carefully. Some contracts have a clause that a fixed allowance covers OT, or you are on a "managerial/confidential" role which may be treated differently. Read what you signed. But even so, there are limits on unpaid hours. If in doubt, the Labour Dept can advise for free.
