Landlord wants to keep my whole 2-month deposit for normal wear and tear

Just moved out of my condo in PJ. Landlord says the walls need repainting and some scratches on floor, so he keeping the full 2 months deposit plus utility deposit. The place was already old when I moved in. Can he do this?

I got most of my deposit back once by being firm but polite. First, always do a proper inventory and photos on day one, that saved me. When my landlord tried the 'repaint whole unit' trick, I replied that repainting due to normal aging is the owner's maintenance cost, and asked for receipts and quotes for any real damage. Suddenly the list got much shorter. If he keeps everything with no proof, you can lodge a claim at the Tribunal for Homebuyer or the magistrate small claims court, it's cheap and no lawyer needed for small amounts. Keep all communication in writing. For anything involving big money, best confirm with a legal aid clinic first.

From my experience renting in the Klang Valley, normal wear and tear should not be deducted, only actual damage you caused. Repainting after a few years of living is usually considered normal, not tenant's fault. The problem in Malaysia is we have no dedicated tenancy act yet, so it comes down to what your tenancy agreement says. Go read your agreement clause on deposit. Take dated photos of the condition now, and dig out your move-in photos if you have. Send the landlord a polite written message quoting the agreement and asking for an itemised deduction. If he refuses unreasonably, you can file a claim at the Tribunal or small claims. For a big sum, worth getting proper legal advice.
